Importing from Korea to the EU? Ask for the Right Origin Declaration

Request the right Korean supplier documents for EU–Korea origin preference: exporter declarations, the €6,000 threshold, authorization details, invoice lines and corrections.

Reviewing commercial invoice product lines and the Korean exporter origin declaration

Your Korean supplier sends a certificate headed “Certificate of Origin,” but your EU import team is asking for an origin declaration on a commercial document. The supplier believes the request is complete; the importer still cannot use the file. Resolve that mismatch by naming the agreement, the goods, the required declaration and the person who can prepare it—not by asking for “the COO” again.

1. Ask for the EU–Korea origin declaration by name

The European Commission’s EU–South Korea FTA guidance explains that the proof used under this agreement is an exporter’s origin declaration on an invoice, delivery note or another commercial document that identifies the products sufficiently. An EUR.1 movement certificate is not the proof used for this agreement. A generic certificate of origin should therefore not be assumed to satisfy this particular request.

First tell the supplier what the import team is trying to establish: a claim for preferential treatment under the EU–Korea agreement for specified goods. Then ask the supplier’s export-document contact whether the products meet the applicable origin requirements and whether it can make the required declaration. “Made in Korea” in a sales email is not the same document.

Document or statement What it addresses Question still to resolve
Commercial invoice Transaction, goods and values Does it carry the appropriate origin declaration?
Ordinary certificate of origin Origin information for its stated purpose Is this the proof required under this agreement?
Business registration Identity of the business Does the exporter have the relevant authorization where required?
Packing list Packages, quantities and weights Which invoice/product lines does the declaration cover?
EU–Korea origin declaration Exporter’s declaration under the agreement Are the exporter, wording, goods and execution correct?

The Korea Customs Service overview of origin documentation also distinguishes preferential and non-preferential uses. State the intended agreement instead of relying on an abbreviation that different departments may interpret differently.

2. Check the €6,000 threshold without confusing it with a company limit

Under Article 16 of the agreement’s Protocol on Rules of Origin, an origin declaration may be made by an approved exporter or by any exporter for a consignment of one or more packages containing originating products whose total value does not exceed €6,000. Above that threshold, the approved-exporter route is relevant. The threshold does not remove the requirement that the products qualify as originating.

Ask the supplier to confirm the basis applicable to this consignment. Do not substitute a Korean business registration number, customs client number or a number copied from an old order for the required customs authorization number. Where approved-exporter status is relied on, request the relevant authorization details for the exporter and have any scope questions resolved by the responsible document contact.

Consignment situation Useful request
Originating-product value at or below €6,000 Confirm origin qualification and the declaration basis for this consignment
Value above €6,000 Confirm approved-exporter basis and relevant authorization details
Invoice includes different origins Identify which lines are covered and the corresponding value
Several packages or invoices Clarify the consignment and documents before applying the threshold
Currency other than euro Ask the responsible reviewer how the applicable value equivalent is determined
Exporter differs from manufacturer Identify the declarant and supporting-origin information available to it

Do not split paperwork simply to make an authorization question disappear. If the shipment structure or valuation basis is unclear, collect the complete order, invoice and packing information and ask for a determination based on the actual movement. Your coordination task is to make that review possible with a coherent file.

3. Match the declaration to the products, not just the invoice total

A shipment dispatched from Korea may contain both Korean-origin and non-originating goods. The country of shipment, the supplier’s nationality and the brand name do not establish preferential origin. The exporter needs a basis for the declaration under the applicable product rules and supporting records.

Prepare a line-by-line document comparison. Copy the product descriptions, model or part numbers, quantities and values from the current invoice. Mark which products the supplier says are covered by the declaration. If a broad description such as “machine parts” hides different products, ask for enough detail to connect the declaration to the order and import review.

Comparison field What to compare Example of an open question
Exporter identity Invoice, declaration and relevant authorization Trading company invoices; factory supplied an unrelated declaration
Product identity Order, invoice and packing list Invoice uses a family name rather than the supplied model
Covered lines Declaration wording and line markings Some lines have different stated origins
Quantity and version Final shipment versus earlier draft Declaration refers to a superseded invoice
Origin basis Exporter’s confirmation for the goods Supplier only confirms that the goods ship from Korea
Consignment value Relevant products and shipment documents Threshold assessed using the wrong subset of documents

You do not necessarily need the supplier to send commercially sensitive production records to every buyer. Ask the exporter to confirm that it has the supporting basis needed for its declaration, and route any specific evidence request from the import review to the right person. Avoid turning a customer-service email into an unsupported origin certification.

4. Use the official wording and review the execution fields

The declaration text is prescribed in Annex III of the protocol. Send the supplier the official protocol PDF, Annex III and ask it to use the applicable official text rather than drafting a free-form “origin confirmed” sentence. In the PDF, the English version appears near the end, followed by explanatory notes.

Field or feature Practical review
Prescribed text Has the exporter used the applicable official Annex III wording?
Authorization number Included correctly where the approved-exporter basis applies
Origin indication Completed for the products actually covered
Commercial document Identifies the products sufficiently and relates to the actual shipment
Place and date Completed or appropriately available from the commercial document under the notes
Signature and name Executed according to the applicable signature requirements
Excluded products Clearly distinguished where not all products are covered

Article 16 normally requires the exporter’s original handwritten signature. The approved-exporter exception depends on the prescribed written undertaking to the customs authorities; approved status alone should not be treated as a blanket explanation for any unsigned document. Ask the exporter to confirm the applicable basis when the signature is omitted.

Do not add the exporter’s signature, authorization number or origin claim on its behalf. If a field is missing, return a marked question list and ask the exporter to issue the corrected document. Preserve the original and corrected versions with clear filenames so the import team knows which is current.

Keep validity and claim timing separate

The protocol provides a 12-month validity period for the proof of origin from its issue date. Procedures for presentation, retrospective documents and a particular importer’s claim need to be checked for the actual transaction. Do not assume that a valid-looking document automatically resolves every timing or eligibility question.

5. Send a supplier request that reaches the export-document person

Subject: EU–Korea origin declaration request: invoice [number]

Hello [Name],

For our EU import of [products/order], please ask your export-document team to review the origin documentation under the EU–Korea Free Trade Agreement.

Please confirm:
1. Which invoice lines qualify as originating under the agreement
2. The exporter that will make the declaration
3. The applicable declaration basis for this consignment, including approved-exporter details where required
4. Whether the prescribed Annex III declaration can be included on the invoice or another commercial document identifying these products
5. The applicable signature basis and any information you need from us

Attached: current invoice, packing list and product-line questions.
Official wording: [link to the protocol, Annex III].
Please send a draft for document review and identify the person responsible for the final version. We are requesting the agreement-specific origin declaration, not an EUR.1 form or an ordinary certificate for another purpose.

Open questions: [list]
Required by: [date and reason]

If the sales contact replies with the same generic certificate, acknowledge it and isolate the missing point: “Thank you. Our remaining request is the exporter declaration under Annex III on a commercial document covering invoice lines 1–3. Please forward this to the person who prepares your EU export documents.”

A short bilingual clarification can help the Korean export team understand the request, while the final declaration must follow the applicable official wording. Korea Ops Desk can contact the supplier, identify that person and maintain a precise question-and-answer record so the importer is not repeatedly explaining the same issue.

6. Correct common mismatches with a specific action list

What you received What to ask next
Generic chamber-issued certificate Request the agreement-specific exporter declaration
EUR.1 form Point to the EU–Korea proof requirements and ask for the appropriate document
Declaration with a business number Ask the exporter to confirm the required authorization details
Unsigned declaration Ask for the applicable signature or documented exemption basis
Old invoice reference Request a corrected document tied to the current shipment
Mixed-origin lines not distinguished Ask which products the declaration covers
Salesperson cannot confirm origin Request the export-document or origin-compliance contact
Documents contain different company names Ask who is the exporter/declarant and how the documents connect

Send a numbered list instead of an annotated screenshot without explanation. Each question should identify the document, page or line and the requested clarification. Keep the answer beside the question in your tracker; a new attachment alone does not tell you whether all open points were resolved.

Where the supplier cannot provide the requested declaration, report that accurately to the import team promptly. The buyer can then assess the commercial and import implications with the available facts. Do not let an assumed tariff saving remain hidden in a landed-cost calculation while the supporting proof is still unresolved.

7. Worked example: three invoice lines and the wrong certificate

An EU buyer receives an illustrative €12,000 invoice from a Korean supplier. Two lines are stated to be Korean-origin products; a third is an imported accessory. The supplier sends an ordinary origin certificate and its business registration number. The buyer’s import team asks for an EU–Korea declaration, and the sales contact says the certificate has already been sent.

  1. Build a three-line comparison showing product, value and stated origin.
  2. Ask which lines the exporter can support as originating under the agreement.
  3. Clarify the consignment value and applicable approved-exporter basis with the responsible exporter contact.
  4. Request the prescribed declaration on a commercial document that identifies the covered products.
  5. Check that the accessory is not inadvertently included in a blanket origin statement.
  6. Have the exporter correct the authorization and execution details where required.
  7. Send the complete current file and remaining questions to the import reviewer.

The coordinator has not “made the goods Korean” or certified tariff eligibility. The useful work is finding the right exporter contact and turning an ambiguous certificate exchange into a document set that can be assessed. That is often the difference between several days of repetitive email and a clear decision.

8. Keep the final record usable for the next shipment

Save the current invoice, packing list, declaration, relevant exporter confirmations and the import review outcome together. Record who supplied each document and its issue date. Keep the superseded draft clearly marked rather than deleting the history or letting it be mistaken for the final version.

  • Order and shipment reference.
  • Current commercial-document versions and product-line mapping.
  • Exporter identity and the applicable authorization/signature clarification.
  • Questions raised, answers received and unresolved items.
  • Final review outcome and the person responsible for the decision.
  • Follow-up needed before the next shipment.

For repeat purchases, use the prior file as a checklist, not a declaration to copy. Products, sourcing, exporter details, values and documents can change. Ask the supplier to issue the appropriate record for the actual shipment and flag any changed facts early.

If your EU import team is waiting for a clearer answer from Korea, send Korea Ops Desk the exact request and the documents already received. We can organize the line-by-line questions, follow up with the supplier’s document team and return a concise English record of answers and corrected files.
